These Terms of Service ("Terms") govern your use of restorebuddy.app and related demo, form, call, and messaging experiences operated by Hersch AI LLC, Colorado ("RestoreBuddy," "we," "us," or "our").

By using the site or submitting a form, booking a demo, or opting into SMS, you agree to these Terms and our Privacy Policy.

What RestoreBuddy is

RestoreBuddy is software and related services for restoration businesses (call answering, CRM, marketing, and related tools). The marketing site describes offerings that may be shown in a demo. A paid subscription or separate agreement is required before you receive production access. Nothing on the site is a guarantee of results, job volume, or revenue.

Accounts and demos

You agree to provide accurate information when you book a demo or submit a form. You are responsible for keeping your contact details current. Demo slots and availability may change.

SMS and communications

If you opt in to SMS from RestoreBuddy:

• You consent to receive texts related to your inquiry, booking, or marketing (depending on the consent you gave)
• Message frequency varies; message and data rates may apply
• Reply STOP to end SMS; reply HELP for help
• Consent is not a condition of purchase

You also consent to email and phone contact related to inquiries you submit.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

Acceptable use

You will not misuse the site, attempt unauthorized access, scrape in a way that harms the service, submit unlawful or harmful content, or use the site to spam others. We may suspend access for abuse or risk to the service.

Intellectual property

Site content, branding, and software are owned by Hersch AI LLC or its licensors. You may not copy, reverse engineer, or reuse them except as allowed by law or with our written permission.

Disclaimers

THE SITE AND ANY DEMO ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HERSCH AI LLC AND ITS OWNERS AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE OR RELATED COMMUNICATIONS. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE SITE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (IF ANY).

Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the site, your content, or your violation of these Terms.

Third-party services

Governing law
